Should I admit I was drinking if a police officer pulls me over?

No.

Do you want to give the police officer evidence to use against you in court? If you’re asked the question, the officer already knows the answer, but doesn’t have proof.

There is no legal requirement to answer a police officer because you cannot be forced to make incriminating statements. You’re not going to make friends and he or she is not going to let you off the hook.

Politely inform the officer that you wish to speak with an attorney. Say no more. You are allowed to consult with an attorney before answering any questions.

Some, but not all, DUI – DWI lawyers advise against taking a Breathalyzer for the same reason. However, if you may lose your driver’s license if you refuse a Breathalyzer.
